CONSENT TO TERMS AND CONDITIONS
Use of the services of Adria Luxury Rent d.o.o. (LTD), (Andrije Hebranga 12, 23000 Zadar, Croatia) and our Web sites is subject to acceptance of these Terms and Conditions (“Terms and Conditions”).
By accessing, using or obtaining any content, products, or services through our offices or through our Web sites, you, the purchaser and/or traveler (“Customer”, “client” and “passenger” and/or “you/your”) agree to be bound by these terms. These terms restrict your rights and remedies and provide protection to Adria Luxury Rent d.o.o. (LTD).
These also include warranty disclaimers and liability exclusions. By using this Web site, you acknowledge and agree (a) this is a fair balance because this Web site is accessible by you conveniently and at no charge to access the Web site; and (b) IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DO NOT AGREE WITH, INCLUDING WARRANTY DISCLAIMERS AND LIABILITY EXCLUSIONS, PLEASE DO NOT USE THIS WEB SITE OR Adria Luxury Rent d.o.o. (LTD) SERVICES. No alterations to these terms and conditions may be made by any Adria Luxury Rent d.o.o. (LTD) employee, authorized representative or agent, unless in writing by an authorized officer of Adria Luxury Rent d.o.o. (LTD). We may modify our terms and conditions without notice at any time where such amendment does not substantially effect your rights and obligations. If such changes of our terms and conditions substantially effect your rights and obligations, we will notify you by email with these changes as they occur.
You agree that we will not be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with the performance or non-performance of any Travel Service Provider, including, but not limited to, non-performance resulting from bankruptcy, reorganization, insolvency, dissolution or liquidation. In the event of non-performance resulting from bankruptcy, reorganization, insolvency, dissolution or liquidation of a Travel Service Provider, you agree that your sole recourse shall be toward such Travel Service Provider and not toward Adria Luxury Rent d.o.o. (LTD) or its representatives.
When you visit the Website or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
BOOKING TERMS, CONDITIONS & PAYMENTS
Adria Luxury Rent d.o.o. (LTD) will make every effort to work with you on adjusting your itinerary, so please don’t hesitate to discuss any aspect of your booking with us.
• 30% deposit - After we have agreed upon the selected villa and you express your desire to want a book a villa with us, Adria Luxury Rent d.o.o. (LTD) will send you an CONFIRMATION OF PAYMENT for 30% deposit, unless otherwise specified. A deposit is due within 3 working days from the time of booking confirmation. Deposit is non refundable at any condition, unless it is agreed by Adria Luxury Rent d.o.o. (LTD).
• The balance of your payment is due at arrival unless agreed otherwise.
After we receive the deposit, we will issue you a confirmation of receipt of payment for your package.. The rental contract is considered concluded at the moment when Adria Luxury Rent d.o.o. (LTD) receives the paid advance amount.
The costs of water, gas, electric power and internet as well as bed-linen, towels, kitchen towels, final cleaning of the interior, maintenance of the swimming-pool and exterior, registration of stay and residential tax and the value added tax are included in the accommodation rental price.
We accept payment via credit card (Visa,Maestro, MasterCard,) or wire transfer.
If paying by wire transfer, you are responsible for all bank fees to transfer and wire the money to us. Adria Luxury Rent d.o.o. (LTD) needs to receive the full amount for your package or service.
Many of our third party suppliers have their own terms and booking conditions and you will be bound by these as they apply to your contract with us as far as the supplier is concerned. Our supplier’s conditions will also apply to your contract with us, and in the event of any conflict between the supplier’s conditions and our conditions, the supplier’s conditions will prevail, unless any term in the supplier’s conditions is deemed to be invalid or unenforceable, in which case our conditions will prevail.
CREDIT CARD PAYMENTS & FEES
Our quotes are in different currencies while all payments will be effected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in foreign currencies into Croatian kuna according to the current exchange rate of the Croatian National bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our proposals or web site. The charged amount on your credit card account is converted into your local currency according to the exchange rate of credit card associations.
Adria Luxury Rent d.o.o. (LTD) a will advise clients of fee and allow clients to decide whether to use a credit card or not.
ENTERING THE TRANSFER OF PERSONAL DATA
Entering the transfer of personal data and credit card number is protected by the highest security standards which provides WSpay ™ system for on-line credit card authorization in accordance with the requirements of credit card and credit card brands and PCI DSS standards. Authorization and payment of credit card works using the system WSpay ™ for authorization and payment card in real time.
Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations, provided actual variations have occurred.
CANCELLATION OF ARRANGEMENTS
All cancellations must be in writing to Adria Luxury Rent d.o.o. (LTD).
In case of cancellations, following cancellation conditions will be applied:
• Deposit of 30% is non refundable at any condition, unless it is agreed by Adria Luxury Rent d.o.o. (LTD).
Final payment can be payed at arrival directly to owner or can be sent at least 14 days prior to arrival if you want to pay before the trip.
Information and pricing are subject to change without notice. In the event of a pricing error, or any omission, Adria Luxury Rent d.o.o. (LTD) reserves the right to adjust the pricing or make any other corrections. Every attempt has been made to include all taxes.
PASSPORT AND VISA REQUIREMENTS
Valid Passport is required for entry into Croatia and surrounding countries.
Please have your passports with you on excursions crossing into surrounding countries/border crossings.
Prior to confirming your travel arrangements, you should check your Passport and establish that it will remain current for the entire period of your travel. Certain countries require that your Passport remains valid for a period of up to six months after the date upon which you are scheduled to leave such country. If your Passport expires less than six months after the date, you are scheduled to leave such country you may be denied entry to that country. You should clarify visa requirements with the Embassies of the countries that you plan to visit as certain countries may require you to take out a visa.
Villa and apartment complexes may sometimes require you to prepay a security deposit for the sole purpose of insuring the owner against any breakages, accidental damage or such caused by your negligence, losses, extra cleaning or outstanding accounts which you may have incurred during your stay. If damage exceeds the maximum applicable amount, you will be responsible for the full cost. The amount will be confirmed to you at time of booking and refunded post your holiday once the villa management agency has inspected the villa on the day of your departure. The inspection where possible will be conducted before you vacate the property so that reimbursement can be approved immediately or any remedial action mutually agreed. However, if this is not practical due to early/late departures the inspection will be conducted on the day of departure and reimbursement made no later than 1 week after departure. If you discover any problems or breakages on arrival, please report them immediately to avoid any misunderstanding once your rental period has ended.
FORCE MAJEURE EVENTS
Adria Luxury Rent d.o.o. (LTD), its agents, representatives, service providers and suppliers are not liable for any damage and/or delay due to "Force Majeure Events" including, but not limited to, acts of God, governments actions, war, hostilities, political unrest, riots, civil strife, industrial disputes, labor dispute, strike, natural or nuclear disaster, fire, theft, epidemics, sickness, equipment malfunctions or breakdowns, weather conditions, quarantine, medical or customs regulations, technical or administrative problems with transport, closure of airports, ferryboat schedule changes, breakdown of machinery, water shortages or any other occurrences and changes beyond our control. In case of a Force Majeure Event, Adria Luxury Rent d.o.o. (LTD) may, at its sole discretion, but shall not be obligated, to offer substitute services that, in Adria Luxury Rent d.o.o. (LTD)'s sole judgment, reasonably replace the originally scheduled service. Adria Luxury Rent d.o.o. (LTD) shall not be responsible for any additional expense, omissions, delays, rerouting or acts of any governmental authority. In the event of a Force Majeure Event, no refund will be provided.
We strongly recommend purchasing comprehensive travel insurance from your country once villa has been booked. Health, accident and emergency evacuation insurance are also strongly recommended. Adria Luxury Rent d.o.o. (LTD) will not accept responsibility for any person who fails to be properly insured for their journey. Travel insurance can further protect you in the event of cancellation due to unforeseen occurrences.
The purchase of travel insurance is not required in order to purchase any other product or service offered by Adria Luxury Rent d.o.o. (LTD). Employees of Adria Luxury Rent d.o.o. (LTD) are not qualified or authorized to: answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage.
Adria Luxury Rent d.o.o. (LTD) highly recommends travel insurance.
MEDICAL CONDITIONS, PREGNANCY AND TRAVEL
If you have a medical condition, or if you are pregnant and considering travel, you must consult with your doctor before you travel, especially if medical condition requires daily routine care, urgent care, or your pregnancy is high-risk. You are responsible for disclosing any related information to us during the check-out process by adding special comments. You understand Adria Luxury Rent d.o.o. (LTD) or local provider is not in a position to provide any medical services or urgent care in the event such an action may be required. You are liable for any risks, incidences or consequences incurred during travel. We highly recommend that you purchase medical insurance and travel insurance before you travel.
LIMITS ON RESPONSIBILITY
Adria Luxury Rent d.o.o. (LTD) acts solely as agents for the client with respect to all transportation, hotel, villa and other tour arrangement suppliers. Neither Adria Luxury Rent d.o.o. (LTD), nor any agent or affiliate accepts any responsibility or liability of any nature whatsoever for the acts, omissions or defaults (whether negligent or otherwise) of any governmental authorities, their officers, or employees or of any employees, or agents of airlines, air carriers, coach operators, other land carriers, shipping companies or operators, cruise or ferry operators, any other transport providers, hoteliers or other accommodation providers, any other facilities providers, tour directors, tour guides, travel agents, or the providers to you of meals, other goods or other services on your holiday or in relation to it and over whom Adria Luxury Rent d.o.o. (LTD), its agents or affiliates have no direct control.
In addition and without limitation, Adria Luxury Rent d.o.o. (LTD) is not responsible or liable for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.
All bookings agreed to be made by Adria Luxury Rent d.o.o. (LTD) with the provider of any transport or other services are subject to the terms and conditions imposed on such suppliers in relation to matters that may not be expressly the subject of our agreement with them and, in particular, to the applicable laws, requirements and policies of any government, governmental authority or employee including, visa, entry, exit or transit.
Neither Adria Luxury Rent d.o.o. (LTD) nor any agent or affiliate accepts any liability or responsibility for any terms, conditions or requirements of any third party who provides some service in the course of your vacation. If you decide that you do not want to visit a country or part of a country you intended to visit because of any law, condition or requirements of any government or governmental authority, official, servant or agent, you are responsible for any costs, expenses, charges, fees, losses or damage incurred as a consequence and any cancellation or amendment fees.
The Contracting Parties agree that all disputes that may have arisen are to be solved in a safe manner and if they do not succeed - the jurisdiction of the Municipal Court in Zadar is explicitly contracted.
